Bily Hardesty Wednesday afternoon waived his right to preliminary exams in District Court, and was bound over to Circuit Court for a Nov. 2 arraignment on five counts of murder and two counts of attempted murder.

Hardesty�s attorneys said they were waiving the preliminary exams because they plan to file a motion to have Hardesty examined by psychiatrists to see if he is competent to stand trial.

That motion is expected to be filed at the Nov. 2 arraignment before Circuit Court Judge William Ager. Wednesday�s proceedings were conducted by 14th District Court Judge Kenneth Bronson in Hardesty�s hospital room where he is recovering from wounds received during a shootout with police last Thursday.

According to Lynwood Noah, senior assistant prosecutor for Washtenaw County, Hardesty was in better condition Wednesday than he had been for his district court arraignment, held in the hospital Tuesday. Wednesday, he sat up in bed and signed his name to the form requesting a waiver for the preliminary exams, which had been scheduled for next week, Noah said.

Noah said doctors had requested that Hardesty not be arraigned while on medication, so he had no pain-killing medication for six hours before the proceedings Tuesday morning. He had been given a shot of morphine Wednesday, Noah explained.

Hardesty is being held without bond on the murder counts. The Washtenaw County Sheriff�s Department is holding him under guard in his hospital room.

Police believe Hardesty killed his parents, Ron and Jan Hardesty, at their Van Buren Township home Oct. 18 before beginning an overnight shooting spree that left three others dead and two wounded.

Troy Curry, 28, of Canton Township, and Timothy Schofield, 22, of Belleville, were found slain early last Thursday in the parking lot outside a downtown Ypsilanti bar.

Daniel Wood, 38, of Canton Township, was fatally shot at an Ypsilanti Township tool and die firm later. Bobby J. Baker, 26, of Westland, and Tommy L. Brown, 29, of Tecumseh were found wounded.
